VICTIMS KNOCK HRC DOOR AHEAD OF UN SCRUTINY DAY


24 January 2011. The families of eight youths from Manau, Bardiya District, who were disappeared at the hands of security forces back in April 2002, have submitted today an individual communication to the United Nations Human Rights Committee (UN-HRC) with the help of Advocacy Forum-Nepal and the REDRESS Trust. The submission is timed to coincide with the Universal Periodic Review (UPR) of the Human Rights Council scheduled to kick off from tomorrow in Geneva.

Under the Optional Protocol to the International Covenant on Civil and Political Rights to which Nepal is a party since 1991, victims can petition the Human Rights Committee, an independent body of experts, if they have exhausted all domestic remedies.

On the night of 11 April 2002, eight young persons - Dhaniram Tharu, Soniram Tharu, Radhulal Tharu, Prem Prakash Tharu, Kamala Tharu, Mohan Tharu, Lauti Tharu and Chillu Tharu - all of Tharu ethnicity, disappeared from their homes in Nauranga village, Ward No.8, Manau Village Development Committee (VDC), Bardiya District. They were aged between 14 and 23; two among them were girls; and five of them were thoughts to be below 18 years old. The disappearances were allegedly committed by a group of 60-70 soldiers who came to the village, with groups of two to five soldiers breaking into the targeted houses between midnight and 2am, carrying torches and weapons. In each house they asked for the disappeared person by name, sometimes even seeming to know the location of that person’s bed.

Having exhausted all available and effective domestic remedies as well as administrative remedies, the families of those disappeared are now submitting a communication to the United Nations Human Rights Committee. The families ask that the Committee find that the state committed violations of the International Covenant on Civil and Political rights ratified by Nepal, and, to declare in particular that the victims were arbitrarily arrested and disappeared by the State and recommend prompt, impartial and thorough investigations into the fate of the victims and prosecute those against whom there is sufficient evidence.

Padam Lal Tharu, father of Radhulal Tharu said: “We have been waiting for the last 9 years to know the truth. We could get neither truth nor justice... I have some new hope now Advocacy Forum and REDRESS have assisted us to take our voices to the Committee.”

Mandira Sharma, Executive Director of Advocacy Forum-Nepal said: “These victims represent many other victims from Bardiya with whom we have been working for years. Sadly, for these victims, the rights enshrined in human rights treaties remain a dream and the mechanisms established for their enforcement inaccessible. By helping these families to bring a communication to the Human Rights Committee we are trying to increase the possibilities of the victims getting truth, justice and reparation.”

Similarly, Carla Ferstman, Director of REDRESS Trust, said: “Enforced disappearances are recognised as among the worst international crimes. We hope that this petition and the eventual response of the UN encourages the Government of Nepal to address the devastating consequences of disappearances once and for all - the families of the disappeared deserve to know the full truth of what happened, and those responsible for the disappearances should be held accountable”.

A joint press statement issued by AF and REDRESS has called upon the government of Nepal to fully comply with its obligations under the ICCPR and its additional protocol, by fully implementing the recommendations of the Human Rights Committee in the Yashoda Sharma case, and by responding promptly and in full to the other cases currently before the Committee and the new case filed by the families of the eight young people disappeared from Manau.

This is the sixth case in which Advocacy Forum and REDRESS assisted victims from Nepal to file communications before the Human Rights Committee.

Families of Bardiya disappeared victims appeal to the UN Human Rights Committee
Today, 24 January 2011, the families of eight youths from Manau, Bardiya District who were taken away by the security forces in April 2002 submitted an individual communication to the United Nations Human Rights Committee with the help of Advocacy Forum-Nepal and the REDRESS Trust. Case:

No news of the eight youths was received by the families for years despite repeated searches in all the army camps and police stations in a 50 kilometre radius and visits to the authorities. In 2006 the army informed the Neupane Committee, the ICRC and OHCHR-Nepal that seven of the young people were killed in crossfire during an encounter with Maoists in the Manau nursery jungle, but did not provide details as to what happened to the bodies. The families refuted the army’s allegations. They say that as the young people left their houses unarmed and under the control of a large group of soldiers they could not have engaged in an armed encounter later that same night. Furthermore, the villagers would have heard if there had been gunshots in the nursery. Finally, no information has been provided about the fate of Prem Prakash.

Advocacy Forum assisted the families of the victims to file habeas corpus petitions in the Supreme Court in 2003. All of the respondents denied detaining the eight young persons. In decisions reached between 24 August 2004 and 25 March 2005, the Supreme Court quashed all of the petitions on the grounds that the Authors could not identify where and by whom each young person was being detained.

Context:

According to reports by OHCHR and national and international human rights organisations, Bardiya District had the highest number of disappearances carried out during the conflict. OHCHR-Nepal received reports of 200 disappearances in the district, other human rights groups have put this number at 240. This figure would account for approximately 20% of all disappearances in Nepal.

The Tharu indigenous group constitutes 52% of the population in Bardiya District.  During the conflict, the Tharu community in Bardiya District appears to have been particularly targeted.  Over 85% of the cases of enforced disappearance documented by OHCHR Nepal in Bardiya District were from the Tharu community. Similarly, 109 of the 160 cases of enforced disappearance examined by the WGEID during its 2006 session were cases of members of the Tharu community disappeared at the hands of members of the security forces.
Other cases before the Committee:

This is the sixth case in which Advocacy Forum and REDRESS assisted victims from Nepal to file communications before the Human Rights Committee. In the first case submitted by Yashoda Sharma (wife of Surya Prasad Sharma, who had disappeared at the hands of the army) the Committee reached a decision on 28 October 2008. It held that the Government of Nepal had committed numerous breaches of its obligations to both the victim and his wife. It recommended that the government promptly initiate a full investigation into the disappearance of Surya Prasad Sharma in 2002, with a view of prosecuting those responsible. It also recommended the prompt payment of adequate reparations to his family. However the government has only partially implemented the recommendation on adequate reparations and no investigation has been initiated. The Government is arguing that instead of conducting criminal investigations into the case, the case will be investigated by the Truth and Reconciliation Commission and the High-Level Disappearances Commission. These mechanisms have yet to be established and their envisaged powers remain ambiguous.

बेपत्ताकी पत्नी घरनिकाला

बेपत्ता पतिको खोजीमा भौंतारिइरहेकी बर्दिया मोतीपुर ५ मदाहागाउँकी शोभारानी थारूलाई परिवारले घरनिकाला गरेका छन् । उनी नातेदारकहाँ बसेर पतिको खोजी र अंश मुद्दा लडिरहेकी छन् ।

'दुःखमा परेका बेला सहारा दिनुको साटो घरबाटै निकाले' उनले कान्तिपुरसित भनिन्, 'घरजग्गा, अंश केही दिएका छैनन् । ज्याला मजदुरी गरेर बाँचेकी छु,' उनले अंशबन्डाका लागि जिल्ला अदालतमा मुद्दा दिएकी छन् । त्यस्तै, बेपत्ता पतिको स्थिति सार्वजनिक हुने आशामा उनी राष्ट्रिय मानव अधिकार आयोग धाउँदै छिन् । स्थानीय शान्ति समितिले उपलब्ध गराएको एक लाख राहत मुद्दा लड्दा खर्च भएको शोभारानीले बताइन् । सासू-ससुराले एक बिघा १७ धुर जग्गा र घर सबै छोरीहरूलाई दिएपछि उनी बेसहारा भएकी हुन् । 'सासूससुराका चार छोरी छन् । छोरा बेपत्ता भयो, अब बुहारीलाई किन राख्ने भनेर घरबाट निकाले' उनले भनिन् ।

बाबुराम र शोभारानीका दुई छोरा थिए । उनीहरू बिरामी भएर मृत्यु भएपछि शोभारानी अहिले एक्लै भएकी छन् । थारू उत्थान केन्द्रले उपलब्ध गराएको ४ हजार सहयोगबाट गाउँमा सानो घुम्ती पसल राखेकी छन् । त्यसबाट जीविकोपार्जन नभएपछि उनी दैनिक ज्यालादारी गर्छिन् । शोभारानीका पति बाबुरामलाई सुरक्षाकर्मीले ०५९ असोज १६ मा पक्राउ गरी बेपत्ता पारेको हो । उनीसँगै गाउँका दरबारी, तुल्सीराम, लक्षीराम, कालीराम र बाँदु थारू पनि बेपत्ता छन् । राष्ट्रिय मानव अधिकार आयोगले उनीहरूको अवस्था यथाशीघ्र सार्वजनिक गर्न, दोषीको पहिचान गरी कारबाही र पीडितलाई अन्तरिम राहतस्वरूप एक लाख उपलब्ध गराउन सरकारलाई निर्देशन दिएको एक वर्ष बित्दासमेत निर्णय कार्यान्वयन भएको छैन ।

'राहत पाइन्छ कि भनेर आएकी हुँ' आयोगको क्षेत्रीय कार्यालय पुगेकी ३८ वषर्ीय शोभारानीले भनिन्, 'यो राहत पनि सासूससुराले लैजाने डर छ ।' आयोगले ०६६ मंसिर ८ मा  निर्णय गरी २२ गते प्रधानमन्त्री कार्यालयलाई उक्त निर्देशन दिएको हो । राष्ट्रिय मानव अधिकार आयोगका क्ष्ाेत्रीय निर्देशक मुरारी खरेलले आयोगका सिफारिस बाध्यकारी कार्यान्वयन भएमात्र दोषीले कारबाही र पीडितले न्याय पाउने बताए । 'दोषीको पहिचान गरी कारबाही गर्नुपर्ने सिफारिस एउटै पनि कार्यान्वयन भएको छैन,' खरेलले भने । इन्सेकका अनुसार राज्य र तत्कालीन विद्रोही माओवादीबाट १ हजार ६ जना नागरिक बेपत्ता छन् । बर्दियामा मात्र माओवादीबाट १४ सहित २ सय २० जना बेपत्ता छन् ।

थरुहट जनता दलद्वारा सशस्त्र बिद्रोह घोषणा

माओवादीबिरुद्ध विद्रोह केन्द्रित हुने -
दिलवहादुर छत्याल, धनगढी, मंसिर १३ - थरुहट तराई जनता दलले सशस्त्र बिद्रोह शुरु गरेको घोषणा गरेको छ। संगठनका अध्यक्ष रेडसनले सशस्त्र बिद्रोहलाई माओवादी बिरुद्ध केन्द्रित गर्ने बताएका छन्। आफ्नो कार्यक्रममा उनले आक्रमण, कब्जा र जनकारवाही गर्नेसम्मका योजनाहरु रहेको बताए। 

उक्त संगठनले सशस्त्र बिद्रोहको शुरुवातमा धनगढी स्थित रेडियो जनअवाजमा आक्रमण र लुटपाट गरेको जनाएको छ।

थरुहट तराई जनतादलको अध्यक्ष रेडसन भनेका को हुन भन्ने अधिकारिक रुपमा पुष्टि हुन नसकेपनि यो संगठनको नेतृत्व लक्ष्मण थारु रोशनले गरेको खुलासा भएको छ।

'हामी केहि जना बसेर राजनीतिक उद्देश्यका साथ शुरुमा रेडियो जनअवाज एफ एम कब्जा गर्ने निर्णय गरेका हौं।' जिल्ला प्रहरी कार्यालयमा हिरासतमा रहेका रामकृष्ण चौधरीले भने - 'आक्रमण गर्ने लगायत पार्टीका योजना लक्ष्मण थारुले बनाएको हो।'

थरुहट जनता दल नामको भूमिगत संगठन लक्ष्मण थारु कै नेतृत्वमा सक्रिय रहेको उनले बताए।

रेडसन भनेर बिज्ञप्ती निकालेपनि रेडसन यहि हो भनेर कसैलाई थाहा नभएको उनले बताए। एफ एम आक्रमण गर्दापनि रोशनकै नेतृत्वमा आफू सहित एक समुह आएको उनले बताए।

अध्यक्ष रेडसन काल्पनिक नाम भएको र रोशनले नै यो बिज्ञप्ती पठाएको उनले बताए। बिगतमा माओवादीमा सक्रिय रहेका रोशनको नेतृत्व रहेको थरुहट जनता दल नामको संगठनले माओवादी अध्यक्ष प्रचण्ड गुट बिरुद्ध जनकारवाही चलाउने चेतावनी दिएको छ।

प्रचण्डको पक्षमा वकालत गरेकोले जनकारवाही स्वरुप नै रेडियो जनअवाज माथि आक्रमण गरेको संगठनका अध्यक्ष रेडसनले जारी गरेको बिज्ञप्तीमा उल्लेख छ।

२ हजार थारु लगायत हजारौ जनताले बगाएको रगतमा मोज गरेको उल्लेख गर्दै माओवादीबिरुद्ध शसक्त प्रतिरोध जनकारवाही अगाडि बढाइने बिज्ञप्तीमा उल्लेख छ।

राष्ट्रियताको वकालत गर्ने तर भित्र भित्रै आत्मसमर्पण, दलाली र चाप्लुसी गर्ने प्रचण्डको जीवनशैली बनको छ। जसले गर्दा थारु लगायत जनजातीले धोका पाएको छ। वदलाभावले होइन, प्रचण्डका बिरुद्ध शसस्त्र बिरुद्धमा उत्रिनुको बिकल्प छैन।- बिज्ञप्तीमा उल्लेख छ।

प्रचण्डका पथमा प्रचारवादी गरेकाले जनकारवाही स्वरुप रेडियो जन अवाज कब्जामा लिएको जनाएको छ।

मंसिर ५ गते साँझ १५। १६ जनाको एक समुह आएर धनगढीमा रहेको रेडियो जन अवाजमा आक्रमण गरेर लुटपाट गरेको थियो।
एफ लुटपाटमा संलग्न अभ्यास लगायतका ४ जनलाई प्रहरीले पक्राउ गरिसकेको छ। अभ्यास पनि बिगतमा माओवादीका बिग्रड कमाण्डर हुन।
मंसिर १५ गतेवाट संबिधानसभाको सभासदलाई थरुहट भुमीमा प्रवेश निषेध गरिने पनि बिज्ञप्तीमा जनाइएको छ। प्राकृतिक सम्पदा काठ, वालुवा, ढुंगा तस्करी गर्नेलाई पनि जनाकारवाही गरिने उल्लेख गरिएको छ। बिज्ञप्तीमा सर्वजातिय प्रतिनिधत्वको राष्ट्रिय राजनैतिक सम्मेलन गर्नुपर्ने, जातिय जनसंख्याको आधारमा राज्यको सम्पुर्ण निकाय, अंग र तहमा पुर्ण समानुपातिक प्रतिनिधित्व तत्काल लागु गर्नुपर्ने र थरुहट सम्पुर्ण कार्यायमा थारु भाषा अनिवार्य लागु गर्नुपर्ने ३ माग राखको छ।
केहि महिना अघि काठमाण्डौमा यौनकाण्डमा चर्चा आएका रोशन यस क्षेत्रमा थरुहट जनतादलले एफ एम आक्रमण र लुटपाट गरेपछि पुन चर्चामा आएका छन।

Murders in Dang, families seek justice

On 23 November 2010 and 24 November 2010 families of the victims killed in two major incidents of killings by the then Royal Nepal Army and the Maoists filed petition of Mandamus in the Appellate Court of Tulsipur, Dang with the assistance of Advocacy Forum. The families are challenging the continuous denial of justice in these cases.

Case 1: Murder of 11 farmers by then Royal Nepal Army

11 farmers of Bargadi village of Dang District were murdered by the then Royal Nepal Army on November 28, 2001 (2058/8/13) while they were working in a paddy sifting yard. The names of the victims are:
Asharam Chaudhari,
Krishna Prasad Chaudhari,
Sitlal Chaudhari,
Prasadu Chaudhari,
Ram Bahadur Chaudhari,
Ruplal Chaudhari,
Khushiram Chaudhari,
Jagaman Chaudhari,
Rishiram Chaudhari,
Jogi Chaudhari,
Somlal Chaudhari.

They were accused of being supporters of the Maoists. According to witnesses, at around 3 pm, armed RNA personnel in uniform entered the village and went to the place where these victims were sifting paddy. Some army personnel said, “Comrade Red Salute!” and ordered all the victims to gather at a single place. The victims followed the order as they feared the army men. Army personnel asked all them to kneel down and then they opened fire at them. The soldiers then drove away.

The petition states, ”Smoke was surging up from the incident spot. We couldn’t go to the incident spot because of the fear of the army. All except Ruplal Chaudhari were dead on the spot. Ruplal was crying for water. His wife dragged him to the hayrick, helped him lean on its support and gave him water. He could not drink water well. We were in dilemma whether to take him to hospital or not. We feared that soldiers may take reprisal if we take him to hospital. We did not know what to do, on the one hand the man struggling for his life, seeking for our help, on the other hand we were fearful if we face the same fate for helping him out. Later we decided to take him to hospital. Family members were weeping for their loved ones. As we were looking for a local stretcher (khatia) to take Rup Lal to hospital, we saw soldiers coming back again with 3 trucks. When they saw Rup Lal being still alive, they shot him dead and take all the bodies with them loading them in the trucks’

Witnesses recall “we heard that the soldiers then took the dead bodies to Mahendra Hospital in Ghorahi and did the post mortem as they wanted it. We even feared to ask the army where the dead bodies were. With the help of the then Mayor of the town, we approached the hospital. We were asked to sign a document that our loved one were killed in an encounter with the security forces. When we denied to sign, we were told that the bodies won’t be given for our last ritual. We were forced by the military to sign. After five days we got the bodies of our loved one. Our loved one werekilled in the paddy field while thrashing the paddy, but Radio Nepal and Television broadcasted the news that 11 armed Maoist terrorists who had come to Bargadi village to loot the villagers had been killed in an encounter with the security forces. We could not bear the pain when they tagged our loved ones being Maoist Terrorists, after killing them cold blood”.

There was no investigation in the case though the Nepalese law requires police to do investigation in any case of crimes. “Instead of investigation, when we approached the police with the written First Information Report (FIR) on November 21, 2008 (2065/08/06) the police refused to lodge the complaint and told us that the case had already been closed as the incident was an accident. In addition, they said that it is a case from the conflict period and the army being involved, the police cannot do an investigation unless the higher authority orders us to do so. There is no other legal recourse left for us than knocking the door of the judiciary, seeking court orders through a writ of mandamus against police and public prosecutors for thorough investigation and prosecution on the case.” This is what family members stated in the petition.

There was a show cause hearing today in the appellate court, we got the solidarity and support from local human rights defenders, local chapter of Bar Association and International Commission of Jurists on the case. The court has ordered police, public prosecutors among other to furnish the information why there was no investigation on the case.

Case 2: Killings of 3 youths by the Maoist in Dang

Three youths, namely Upendra GC, Gir Bahadur Thapa and Suvas Roka, from Dang were abducted by Maoists on February 21, 2002. While the family members were searching for them, they found pamphlets at Bahundanda forest, signed by the Maoist district-level leader stating that the three youths had been “wiped out” for spying against the Maoists. Though the pamphlets were found, no bodies were recovered. The anguished, terrified family members later came to know that their bodies had been thrown in the Bahundanda forest 9 days after the incident.

The petition states, “Once we found the bodies, we informed the police. However, the police stated that because of the security condition they could not go to the place. They said that, ‘if you bring the bodies by yourselves, we can proceed with the case.’

Witnesses recalled, ‘All three of them were brutally killed, Upendra GC’s body was facing north, his head was burnt, his left hand was broken, his right leg, thy, calves and hands were full of cut injuries. Kerosene might have been poured on the heads and fire had been set on them. Going through the bodies, we suspected victims had been murdered elsewhere and thrown there. Suvas Thapa had been shot in the forehead and chest while Girbahadur’s body was riddled with bullets. Moreover, one of his hands and legs had been severed from the body. His penis too had been cut off.” The victims’ family members took the bodies to Mahendra Hospital where the post mortems were done.

The petitioners in their petition claim, “The Police did not carry out any investigation though the FIR was registered on 8 March 2002. The law cannot provide immunity for an act of abduction and intentional homicide of our innocent loved ones on suspicion of spying for the army. The authority and person must be held accountable for their acts of abducting and killing of innocent people. Thoseresponsible for these grave criminal offences should be punished as per the law. The law should be mandatorily and equally upheld, respected and carried out. The perpetrators of serious criminal offences like intentional homicide are punishable by the civilian court. These kinds of incidents will recur in society as the encouragement of the criminals is enhanced, when they get immunity in the name of rebel forces during the time of conflict. These kinds of acts are detrimental to the development of society. Therefore, it is the state’s obligation to identify the accused and to prosecute them. The Police are supposed to proceed with the investigations even in the absence of a written complaint by the victims' families. Though the filing of the complaint by the victims' side contains all the details regarding the incident, the police did not investigate into it which has ridiculed the rule of law and thereby fostered impunity.”

The show cause hearing on this case will be tomorrow in the appellate court tomorrow.
