SC seeks govt response on TRC

KATHMANDU, APR 13 - The Supreme Court (SC) on Wednesday issued a show cause notice to the government and the Legislature-Parliament asking why they failed to form two important Transitional Justice (TJ) mechanisms—truth and reconciliation commission (TRC) and the commission on enforced disappearances—as stated in the Interim Constitution.
In response to a writ filed demanding an immediate formation of the two mechanisms, a single bench of SC Justice Girish Chandra Lal issued a show cause order to the government and the House, asking why they delayed in forming the mechanisms.
The writ was filed jointly on April 7 by Magna Carta Centre, Nepal Chairman Achyut Acharya and advocates Shyam Babu Kafle and Bhim Prakash Oli demanding the apex court intervention in the mechanisms' formation.
According to the writ, the bills on these mechanisms, which were registered more than a year ago, have been pending in the parliament. The government and the House have been deferring the endorsement of the bills related to TRC and disappearance commissions, which is against the spirit of the Comprehensive Peace Agreement and the ongoing peace process. This is also against the recommendation of the National Human Rights Commission.
The writ had named the prime minister's office and the peace and law ministries as defendants.

KATHMANDU: The Supreme Court today issued show cause notice to government authorities demanding explanation on why they did not form the Truth and Reconciliation Commission (TRC) as required by the Interim Constitution of Nepal. A single bench of Justice Girish Chandra Lal issued the order to the Office of the Prime Minister and Cabinet, Ministry of Law and Justice, Ministry of Home Affairs and the Parliamentary Secretariat asking them to submit the explanation within 15 days. Human rights activists including Achyut Acharya had filed a PIL seeking apex court order to the government authorities to form the TRC.
